Terms and Conditions

The iTennis Coaching Academy (ICA) welcomes you to our tennis family, which runs all year round. Our term programs will always run during public holidays, unless otherwise specified. To ensure you are provided with the best service possible, please take a moment to read the following Terms and Conditions.


WARNING: This is a legal document that affects your rights. If you are uncertain or uncomfortable with some of the conditions of registration, then we recommend that you obtain advice to ensure you understand and accept the conditions of entry.


I agree that my child/children/I/enrolled member can engage and participate in the services and events conducted by the ICA on the following basis;


1) Bookings

Wet Weather and Heat Out
Wet weather cancellation notifications will be posted on our website, www.itennis.net.au as early as possible by our team. Unfortunately, we are unable to provide make-up sessions to customers who assume lessons are cancelled due to wet weather. Some classes will go ahead in the rain if it is light enough to be deemed safe.


If the temperature is 38 degrees or higher, lessons will be cancelled. Please note that rain and heat can vary from area to area. 


If you don’t see a current update on our website, the lessons will run as normal. As a courtesy customers will be eligible for make sessions for all wet weather cancellations. Please see our make-up lesson policy below.


Cancellations
Cancellations must be communicated to ICA 24 hours prior to the commencement of the class. Customers who fail to notify ICA are ineligible for make-up sessions. Please be aware make-up sessions are subject to availability and must be completed within the same term. Up to one change of session can be done per make up. We realise that there are many things that come up in people’s everyday lives. We sympathise with this, but cannot absorb the financial responsibility of repetitive last-minute cancellations. Coaches and session times have been allocated for booked lessons and unfortunately cannot be rescheduled or cancelled without the required notice of a minimum of 12 hours before your lesson.


In the event that you cancel your booking with less than 12hrs notice, ICA also reserves the right to charge a cancellation fee as follows:

  • Bookings cancelled within 1 hour of your booking: 100% of the value of the booking.

  • Bookings cancelled between 1 and 12 hours' notice: up to 50% of the value of the booking


Make-up Sessions
ICA offers make-up sessions as a courtesy for customers affected by wet weather, heat outs and communicated cancellations. ICA reserves the right, at their discretion, to offer (/not offer) a make-up session for the cancellation. Make-up sessions must be booked in advance and used within the same term. Make-up sessions are also subject to availability only. One change is allowed per make up lesson.


Refund & Credit
All refund requests will be reviewed on a case-by-case basis. ICA reserves the right to issue account credits to a customer account in lieu of a cash refund.


Payment Recovery & Associated Costs

In the event a client fails to pay for services rendered by ICA and/or have booked in for without payment, the debtor/s shall pay for all costs incurred by ICA in the recovery of any monies owed, as well as the original amount owed.  Under this agreement, costs of recovery include recovery agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis. We reserve the right to take legal action to recover owed monies and outsource the debt to an external debt collecting agency.

Injury Credit Policy
Customers who are injured and unable to participate in sport will receive a credit for their missed sessions. Credits must be used the following tennis term. Alternatively, the remaining sessions can be transferred to a family member or friend. All injury exemption requests must be accompanied with a valid medical certificate covering date/s of the program/s missed.


Free Trial

Free trials are offered by ICA for group classes only. These trials are strictly for new members only, one per customer and are subject to availability.


Payment Terms for All Bookings
ALL programs must be paid in full as shown as Due on your invoice. As a client of ICA, you are automatically enrolled for each upcoming school term. If you wish to withdraw from the program or switch times or days, we need 14 days’ notice. You will be invoiced in week 8 for the following term. We plan our coaches, courts and players well in advance so once the term has started your spot is reserved and your invoice becomes outstanding.


Late payment: Customers who fail to pay their account before the due date will be subject to a late payment fee of 4%. Overdue accounts of over 30 days will incur an additional 4% late payment fee. Please contact us with any payment issues.


PLEASE NOTE: If payment is not received by the due date, your place in the program may be lost. If you have difficulty with payment, then please contact us to discuss.

Every program allows for a minimum and maximum number of participants. Should your child be enrolled in a program that at the beginning of term does not have the minimum number of children enrolled, ICA reserves the right to cancel the program. You will then be provided with an alternative day/time for the same program. Should you be unable to commit to the alternative day/time offered, you will receive a full refund for your enrolment.

Special Note: By enrolling in a program (ie. online, over the phone or in person) you acknowledge and agree to all Terms and Conditions set out in this document.


Competitions 
You agree to abide by ICA and Tennis Australia (TA) competition rules, etiquette, term and conditions.


Awards
You agree to accept that rewards and prizes such as ice blocks, sweets, lollies, toys, merchandise, soft drinks or chips may be given to the participant.


Booking Rights
You warrant that:

a) all personal details provided are true and accurate;

b) you have all necessary rights as a player, parent or guardian to grant the rights;

c) All information provided is not obscene or defamatory;

d) You will indemnify ICA against any loss or damage resulting from any breach of these Terms and Conditions.

e) You acknowledge that ICA is under no obligation to exercise any of the rights outlined.

f) I certify that I am a player/parent/legal guardian/entrant and I have read this document and understand and accept the terms and conditions it contains.


Supervision
I agree that ICA is not responsible for supervision of my child/children before or after the session has commenced/finished.


Consent to use images

I acknowledge that ICA may film, use video analysis and photography during their programs, lessons and events. I acknowledge and agree that this usage, including for marketing & promotion purposes, is without compensation or notice to myself. Images may be used on our website, social media and other promotional material.


Consent to venue changes 

I agree that venue changes can occur due to scheduling arrangements.

2) Safety and Medical

Medical
All entrants/players/students/parents authorise ICA to obtain medical assistance, treatment and transport as deemed reasonably necessary by ICA and acknowledge that they the person or their parent/guardian will be responsible for any costs associated with any such medical treatment and/or transportation and indemnify ICA from any such costs.


I understand that I/my child/children should not participate in this event/events unless responsible, educated and social and in a fit state to complete the event safely. I acknowledge that if I am aware of an existing medical condition and uncertain of my/child/children's state of fitness then a medical practitioner should verify my physical condition.


I have provided or attached to my entry form details of any medical or physical conditions from which I, my/child/children suffer that might affect my, or our performance or be relevant if medical treatment is needed.  I accept the risk of participating despite these conditions.  I have supplied an emergency contact name and number; this person is contactable both during and after the event and is not another participant.


All participants must be toilet trained or otherwise accompanied by an adult/parent or supervisor.


Suppliers
ICA has no liability for any act, omission or default, whether negligent or otherwise of any supplier. We have no liability for any loss or damage occasioned by the negligence, act or omission of any supplier or other third party. In circumstances where liability cannot be excluded, such liability is limited to the value of the purchased goods.


Insurance
a) You, your child/children are insured with Public Liability, Products Liability, Property Damage and Professional Indemnity under Tennis Australia underwriter Sportscover Australia Pty Ltd.

b) I understand that the insurance cover with ICA coaching services may not cover me for all injury, loss or damage sustained by myself, my child or the player enrolled into our program. ICA is not liable for any other damages not covered by Sportscover Australia Pty Ltd. All persons enrolled in any ICA programs participate at their own risk.


3) Property and Entry

Security Cameras
Security cameras operate within some ICA centres/venues/facilities. Entrants acknowledge that they may be filmed.


Conditions of Entry
Entrants must behave appropriately and follow the lawful directions of ICA at all times. Derogative comments, abusive language and inappropriate or disruptive behaviour will not be tolerated under any circumstances.


ICA reserves the right to refuse entry to any person or remove any person from its tennis centres/venues/facilities.


Damage

If an entrant, player or student causes any damage to ICA property/facilities/equipment they will be held responsible for all costs associated with replacement and/or repairs whichever is decided by ICA.


Personal Property
Entrants are responsible for their own property at all times. ICA does not accept any responsibility for any property that is stolen, lost or damaged in the ICA centres/venues/facilities.


Authorised Tennis Coaches
Only authorised ICA coaches are permitted to provide tennis coaching or lessons at ICA centres/venues/facilities. This includes the use of coaching baskets or other coaching equipment on court. Entrants must not receive any tennis coaching or lessons at ICA centres/venues/facilities except from an authorised ICA coach. This will be strictly enforced.


4) Declaration, Waiver and Indemnity

Release and Indemnity
I acknowledge that coaching, competitions, camps and all other events or activities conducted by ICA, expose my child/children/I/enrolled member to certain risks when using the facilities, including but not limited to physical injury and death, psychological abuse or permanent injury, arising from various causes such as overexertion, equipment, food consumption, transport, dehydration, accidents with other competitors, spectators or other users, weather conditions and other causes. All entrants enter ICA programs at various centres/venues/facilities at their own risk.


In consideration of the applicants, participation in ICA programs, I agree to release, defend, hold harmless and indemnify ICA and its directors, partners, staff, contractors, sub-contractors, officers, employees, and volunteers from any actions, claims, demands, expenses howsoever arising from any injury, loss or damage incurred in connection with my/our participation in ICA programs. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.


5) Privacy Policy

ICA is strongly committed to protecting your privacy. We will only store this information to be used for the management of ICA, and your private information will never be shared with any third party unless required to do so by any Australian or State Law.

The Player Agrees to

  • Attend the Academy regularly and punctually, behave with self-discipline and give notice of and reason for any absence.

  • Be positive and respectful towards players, students and coaches.

  • Refrain from using inappropriate language at all times.

  • Not criticise anyone, on or off the court.


The Parents / Guardians Agree to

  • Encourage and support players and students without pressure, with praise for good work and refrain from criticising.

  • Set a good example for the players/students.

  • Communicate with the academy staff, keeping them informed about matters affecting the player.

  • Refrain from making comments to their own children or other children in the programme during a session or game. It is unhelpful and creates distraction and confusion. If you have concerns, please wait until after the lesson or game to discuss with the coach.

  • Not air grievances in front of other players, students or parents.

  • Refrain from using inappropriate language at all times.

  • Maintain a respectful attitude towards all players, students, parents, coaches and match officials

  • Parents will not “coach” from the side. Please leave the coaching to the coaches.
